Terms of Service

General

These general terms and conditions (the “Terms”) apply to the placing of orders and to purchases of products made by consumers and non-consumers on https://shop.einride.tech/ and related pages (the “Website”). The Terms will constitute an integral part of the agreement between you and Einride AB, reg. no 559074-8926, having its registered address at Regeringsgatan 65, 111 56 Stockholm, Sweden (“Einride”) when purchasing products on the Website. You accept these Terms by using the Website or by placing an order of products on the Website. Therefore, Einride kindly advise you to read the Terms carefully before using the Website or placing an order.

Order

An order of products on the Website becomes binding upon receipt of a written order confirmation from Einride. The order confirmation is sent to the email address provided by you when placing the order. Einride recommends that you keep the order confirmation, as it constitutes the receipt of your purchase. Einride shall have no liability in case a product is sold out or if a product cannot be delivered for any other similar reason. Einride may refuse or cancel an order in case a product cannot be delivered due to any of the above mentioned reasons. If Einride cannot deliver your order, either wholly or a partly, you will be notified via the email address provided by you when placing your order. You must be at least 18 years old to place orders and purchase products on the Website. If you are not at least 18 years old or if you do not comply with any other provision of these Terms, Einride reserves the right to refuse or cancel your order on the Website.

Customer data

It is important that you provide correct and accurate personal details (e.g. name, email address and delivery address) and other information when placing an order on the Website. Einride is not responsible for any incorrect or inaccurate details provided by you. It is recommended that you immediately contact Einride’s customer service if you suspect unauthorized use of your details. Prices and payment

When placing an order on the Website, the prices published on the Website applies. The prices are in Swedish kronor (SEK) and Euro (EUR) and are inclusive of VAT. Delivery costs and any costs for the processing of your payment are not included in the price of the product. Unless otherwise agreed in writing between you and Einride, you will bear these costs. You may choose between the available methods of payment presented when placing the order: Visa, Mastercard, Amex, Maestro, Klarna Pay Later, Klarna Pay Now, Klarna Slice it, iDEAL, Bancontact, Shop Pay, Apple Pay, Google Pay Einride’s payment service provider Shopify Payment handles the payment process. Einride does not process any card or payment details. The payment process is governed by Shopify Payment’s terms and conditions https://www.shopify.com/legal/terms-payments-se. If you have any questions on the payment of products, please contact onlineorder@einride.tech. In case there are price errors or any other inaccurate information about a product presented on the Website, Einride reserves the right to refuse or cancel your order. Einride shall have no liability for inaccurate information about a product published on the Website. If the purchase is made from outside of Sweden, mandatory taxes and other charges may be imposed. Delivery and delivery costs

Einride delivers products within the European Union, Norway, Switzerland and North America. Einride reserves the right to refuse or cancel orders to delivery addresses outside these countries. Delivery is normally made within the timeframe confirmed in connection to the placing of an order. The delivery time is an estimate from Einride. Delivery may take longer than estimated. Einride or any of Einride’s logistic partners will make delivery of your order. Delivery is made to the address provided by you when placing your order or to a post agent nearby such address. If your order is delivered to a post agent, you need to collect your order within the timeframe presented in the delivery note. When you collect your order from a post agent, you need to follow the instructions set out in the delivery notice. You will also need a valid ID. Einride offers the following delivery methods: (i) DB Schenker - shipping within Sweden - Rates from 5 Euro, depending on order weight. (ii) UPS WorldWide - shipping within European Union Countries + Norway and Switzerland. Rates from 15 Euro, depending on order weight. (iii) UPS WorldWide - shipping to USA, Canada, Mexico - Rates from 30 Euro, depending on order weight. Under certain circumstances, you may be entitled to cancel your order in the event of late delivery. If you do not collect an order delivered at a post agent within the stipulated timeframe, Einride reserves the right to charge you for the delivery costs of the return of the order. These costs will be deducted from the amount that Einride refunds to you.

Right of withdrawal

If you are a consumer, you may have a right of withdrawal when purchasing products on the Website. The right of withdrawal means that you may withdraw your purchase without presenting any reason for doing so. The right of withdrawal must be exercised within 14 days from the date you received the product. Please note that the right of withdrawal does not apply to all types of purchases and products. An explanation of what products and what purchases the right of withdrawal do not apply to is provided on www.konsumentverket.se or on [Link to the website of any other competent consumer protection authority in other countries as applicable]. In the event that you exercise the right of withdrawal, the product shall be returned to Einride in the same condition and in the same original package as it was received in. If you want to exercise the right of withdrawal, please contact Einride’s customer service (e.g. via email) and provide a clear and informative message about your decision to exercise the right of withdrawal. You may also use the standard form available at www.konsumentverket.se. Einride will provide an address where you may send the relevant product. The costs of returning the product, such as delivery costs or postage etc., will be borne by you unless otherwise agreed. If you exercise the right of withdrawal, Einride will refund what you have paid for the product. You will be refunded without undue delay and no later than 14 days from the date that Einride received your message to exercise the right of withdrawal. Einride may withhold the refund until the product has been received by Einride or until you can provide a creditable confirmation stating the product has been returned. Einride will use the same payment method for the refund as was used when paying for the product, unless otherwise agreed. In case of depreciation of the value of the product, or the package it was delivered in, you are under obligation to compensate Einride for such depreciation.

Complaints

It is important that you examine your order upon delivery. If you detect any damage to the products, or if the products in any other way deteriorates from what you could reasonably expect, please notify Einride. Complaints shall be made to Einride’s customer service. When making such complaints, you must provide the order number and the reason for the complaint. Thereafter, Einride will keep you posted on how your complaint will be handled.

Responsibility

For consumers, the Swedish Distance and Doorstep Sales Act (SFS 2005:59) and the Swedish Consumers Sales Act (SFS 1990:932) (or any other applicable mandatory consumer protection legislation) apply to the placing of orders and purchases of products on the Website. Einride shall have no liability for any damage to non-consumers when placing orders or when purchasing products on the Website. Einride shall have no liability for errors or defects related to the Website, such as loss of data or other IT related damage etc.

Force majeure

Einride shall be relieved from liability for a failure to perform its obligations under these Terms to the extent that such performance is prevented by reason of any circumstance beyond Einride’s control which could not reasonably have been foreseen or taken into consideration prior to confirming the order.

Governing law and dispute resolution

These Terms shall be governed and construed by and in accordance with Swedish law. Disputes related to the interpretation and application of these Terms shall primarily be resolved by negotiations with Einride. If such dispute cannot be resolved by negotiations with Einride, you, as a consumer, may submit a complaint via the EU Commission’s dispute resolution platform http://ec.europa.eu/consumers/odr, which will transfer your complaint to the correct national body responsible handling such disputes. Einride will comply with the decisions and recommendations made by the body handling the dispute. For non-consumers, the courts of Sweden shall have exclusive jurisdiction over disputes related to the interpretation and application of these Terms.

Miscellaneous

Any attempt of fraud or similar will be reported to the relevant authority. Einride reserves the right to refuse or cancel an order in case in suspicion of criminal acts. Einride shall have no liability for any refusal or cancellation of an order in accordance with these Terms. Title to the products remain with Einride until full payment has been made. Einride reserves the right to refuse your use of and purchase on the Website at Einride’s own discretion, e.g. if you have violated these Terms.

Amendments

Einride reserves the right to amend these Terms at any time. The latest version of these Terms will be published on the Website. Amendments to these Terms become effective 30 days after published on the Website, or when you accept the Terms. Einride therefore advise you to keep yourself updated on any amendments to the Terms.
